Welcome to Swips. These Terms of Service govern your use of swipsband.com and your purchase of products from Kiki Works, LLC doing business as Swips. By accessing our site or placing an order, you agree to these terms. If you do not agree, please do not use our site.

Who We Are

Kiki Works, LLC is a California limited liability company doing business as Swips. In these terms, Swips, we, us and our refer to Kiki Works, LLC. You can reach us at support@swipsband.com.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase from our site. By placing an order you represent that you meet this requirement.

Our Products

Swips wristbands are athletic sweatbands containing a rosin blend insert designed to improve grip during sports and fitness activities. Our products are intended for external use only.

Rosin is a natural pine resin. If you have known sensitivities or allergies to rosin, pine products or magnesium carbonate, review the product materials before use and discontinue use if irritation occurs. Swips products are not medical devices and are not intended to diagnose, treat, cure or prevent any condition.

Product colors shown on your screen may vary slightly from the physical product.

Orders and Payment

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order, including orders that appear fraudulent or that resellers place in bulk without authorization. Prices are listed in US dollars and may change without notice. You are responsible for applicable sales taxes, which are calculated at checkout.

If we cancel an order after payment, we will issue a full refund to your original payment method.

Shipping

Shipping times shown at checkout are estimates and not guarantees. Risk of loss passes to you upon our delivery of the order to the carrier. See our Shipping Policy for details.

Returns and Refunds

Our Refund Policy governs returns, exchanges and refunds and is incorporated into these terms by reference.

Intellectual Property

All content on this site, including the Swips name, logo, product designs, taglines, text, graphics and images, is the property of Kiki Works, LLC and is protected by trademark, copyright and patent laws. Wearable Rosin on Demand is a trademark of Kiki Works, LLC. Swips products are patent pending.

You may not use, reproduce or distribute our content or marks without our prior written permission.

Acceptable Use

You agree not to use our site for any unlawful purpose, to interfere with the operation of the site, to attempt unauthorized access to our systems or to scrape or harvest data from the site.

User Content

If you submit reviews, photos or other content to us or tag us on social media, you grant Kiki Works, LLC a non-exclusive, royalty-free, worldwide license to use, reproduce and display that content in connection with our business, including marketing.

Disclaimer of Warranties

Our site and products are provided on an as-is and as-available basis. To the fullest extent permitted by law, Kiki Works, LLC disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that use of our products will improve athletic performance or prevent injury.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, Kiki Works, LLC and its owners, officers and employees will not be liable for any indirect, incidental, special or consequential damages arising from your use of the site or products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Kiki Works, LLC from any claims, damages or expenses arising from your violation of these terms or your misuse of our products or site.

Governing Law and Disputes

These terms are governed by the laws of the State of California without regard to conflict of law principles. Any dispute arising from these terms or your purchase will be resolved in the state or federal courts located in Orange County, California, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may update these terms from time to time. The version posted on this page at the time of your order applies to that order. Continued use of the site after changes are posted constitutes acceptance of the updated terms.
